Marijuana in Mississippi

At the time of writing, Mississippi is the latest state to implement a medical marijuana law, making it the 37th state to have a legalized medical marijuana program. The legislation was signed into law by the governor in February 2022, and the program is managed by the Mississippi State Department of Health.

Despite being new, the medical marijuana laws in Mississippi are more inclusive than one might anticipate. Additionally, there is an ongoing debate regarding the legalization of recreational marijuana and state reciprocity laws in the state.

Is medical marijuana legal in Mississippi?

Until 2022, marijuana use in Mississippi was strictly illegal at both the state and federal levels, with no exceptions. Even the decriminalization process took considerable time, following the trend in other states. However, through persistent efforts, progress was made.

Recently, Mississippi residents voted in favor of allowing medical marijuana use in the state, making it accessible to patients across the region. The application process for medical marijuana cards began in June 2022, with a five-day approval period for patient registrations. For licensing operations, the approval process may take up to 30 days.

To apply for a Mississippi medical marijuana card, patients must provide proof of their qualifying condition(s) along with a diagnosis from an approved medical provider. Under the new law, the state will establish and oversee legal medical dispensaries where patients can purchase their cannabis products safely and legally.

 

Is recreational marijuana legal in Mississippi?

As of now, Mississippi does not allow for recreational marijuana use. While they have recently passed a medical marijuana law, it may be some time before they consider legalizing recreational use.

For Mississippi residents who wish to use marijuana legally, obtaining a medical marijuana card is the necessary step. This card grants the privilege to purchase, cultivate, use, or possess marijuana within the confines of the law. Without a valid medical card, engaging in any of these activities would be a violation of both state and federal laws.

 

Medical Marijuana laws in Mississippi

After the governor’s immediate signing of the new Mississippi medical marijuana law, it will take some time for manufacturers and dispensaries to become operational and for patients to register properly, allowing them to purchase cannabis within the state.

For patients with qualifying conditions, the law allows the daily purchase of up to 3.5 grams of marijuana or one gram of concentrate. The monthly limit will be three ounces of cannabis in any form.

The law permits the use of cannabis in various forms, including flower, extracts, edibles, beverages, ointments, topicals, tinctures, oils, and even suppositories.

However, certain circumstances are still prohibited under the Mississippi law. Public consumption, use in the workplace, operating vehicles or transportation methods like motor vehicles, boats, trains, airplanes, etc., is not allowed.

Employers retain the right to drug test employees and decide whether to permit medical marijuana patients in their employ.

Federal laws still prevent CDL drivers and other federally-based employees from becoming medical marijuana patients in Mississippi. The Department of Transportation sets federal guidelines for drivers, which cannot be altered by the state.

As with most medical marijuana laws, the Mississippi law is likely to change and evolve over time.

 

Getting a Medical Marijuana card in Mississippi

Starting in June 2022, the application process will involve patients visiting a qualifying medical provider to obtain a diagnosis that matches one of the qualifying conditions listed below. They will then submit this documentation, along with proof of residency and the registration fee.

Once approved, the state will issue the Mississippi medical marijuana card, enabling patients to purchase marijuana from dispensaries across the state.

As the program develops, the state will offer additional resources for patients, caregivers, and qualifying providers, providing detailed information on the process and application guidelines.

 

Mississippi Medical Marijuana Qualifying conditions

The new Mississippi Medical Cannabis Program includes an extensive list of qualifying conditions and treatments, such as:

Reciprocity in Mississippi

Some sources suggest that Mississippi had discussions about reciprocity guidelines for medical marijuana in 2021 when the bill was being considered. While it was mentioned that out-of-state patients may need to register with the Department of Health to make purchases, there are conflicting reports on whether formal reciprocity laws have been enacted.

As medical marijuana legalization is relatively new in Mississippi, it’s possible that reciprocity laws may be established in the future as the program develops and evolves.

 

Cultivating in Mississippi

Patients or caregivers will continue to be prohibited from cultivating marijuana for personal use. Instead, they will be required to purchase it from state-licensed companies and will be subject to a 5% tax in addition to the standard state sales tax. Currently, only a restricted number of facilities have been approved for the cultivation of medical marijuana within the state. Any individuals found growing marijuana without proper licensing will be held accountable under the existing state and federal laws.

 

Dispensaries in Mississippi

Mississippi recently approved medical marijuana, and if everything goes smoothly, the licensing process for dispensaries could start within six months. Consequently, the program might be operational by the end of 2022.

Unlike the initial plan that restricted dispensaries to specific zones, the new law allows any business or company to apply for licensure as a cultivator or dispensary. They are also free to operate in any area zoned for such purposes, giving them more location options.

The law mandates that all cannabis cultivation and dispensing must occur in closely monitored and secure facilities. To prevent excessive purchases, the computer system will track patient days, ensuring compliance with the state’s allowed limits. Furthermore, all dispensaries will utilize the same state-based tracking system, preventing patients from purchasing beyond their monthly allotments by switching to different dispensaries.

 

Is online ordering an option in Mississippi

Currently, patients in Mississippi cannot purchase medical marijuana online; they must personally visit a dispensary. However, minor patients or those who are physically or mentally unable to do so can designate a caregiver to make purchases on their behalf.

In the future, some dispensaries might adopt online ordering options, following the example of other states. But as of now, it remains illegal for Mississippi residents to buy weed online.

Nevertheless, the new medical marijuana law is a positive step, as it simplifies the process for individuals with qualifying conditions to access the medicine they need.

New York’s current marijuana laws do not permit medical marijuana reciprocity. Consequently, you cannot use an out-of-state medical card to access medical marijuana in New York.

Can New York Med Patients Cultivate (Grow at home)?

Individuals who are 21 years of age or older in New York can cultivate cannabis for personal use within their homes. They are allowed to grow up to 6 cannabis plants, with 3 plants being mature and 3 plants being immature. However, it’s important to note that the immediate home cultivation of cannabis is not permitted. Each household is limited to a maximum of twelve plants, consisting of 6 mature plants and 6 immature plants.
